2. Services Description
Dream Diver provides comprehensive IT services including:
- Custom software development
- Web application development
- Mobile application development
- Digital marketing services
- IT consulting and training
- Cloud solutions and deployment
Service Availability
We strive to maintain service availability 24/7, but we do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible.
3. User Responsibilities
As a user of our services, you agree to:
- Provide accurate and complete information when required
- Maintain the confidentiality of your account credentials
- Use our services only for lawful purposes
- Respect intellectual property rights
- Not attempt to breach our security systems
- Comply with all applicable laws and regulations
4. Payment Terms
Project-Based Services
- Payment schedules will be outlined in individual project agreements
- Generally, we require 50% upfront payment before project initiation
- Remaining balance is due upon project completion or as per milestone schedule
Recurring Services
- Monthly services are billed in advance
- Payment is due within 15 days of invoice date
- Late payments may incur additional fees
5. Intellectual Property
Ownership Rights
Upon full payment for custom development projects, clients receive ownership rights to the delivered software. However, Dream Diver retains rights to:
- Proprietary frameworks and tools used in development
- General methodologies and best practices
- Any pre-existing intellectual property
Third-Party Components
Some projects may include third-party components with their own licensing terms. Clients are responsible for compliance with such licenses.
6. Confidentiality
Dream Diver is committed to protecting client confidentiality. We will:
- Keep all client information strictly confidential
- Not disclose project details to unauthorized parties
- Sign additional NDAs when required
- Implement appropriate security measures to protect data
7. Limitation of Liability
Dream Diver's liability is limited as follows:
- Total liability shall not exceed the amount paid for the specific service
- We are not liable for indirect, incidental, or consequential damages
- Force majeure events are excluded from liability
- Client data backup and security are shared responsibilities
8. Termination
By Client
Clients may terminate services with 30 days written notice. Completed work will be billed according to the agreement.
By Dream Diver
We reserve the right to terminate services for:
- Non-payment of invoices
- Violation of these terms
- Abusive or threatening behavior
- Illegal activities
9. Governing Law
These terms are governed by the laws of the Netherlands. Any disputes will be resolved through:
- Initial good faith negotiation
- Mediation if negotiation fails
- Arbitration in Rotterdam, Netherlands
10. Changes to Terms
Dream Diver reserves the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified terms.
